Privacy Policy

Fresh Mart (hereinafter, "Company," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and who we share it with when you place an order through the Fresh Mart mobile application (the "App"). By using the Platform, you agree to the practices described here.
The App does not offer accounts, profiles, or sign-in. You order as a guest, and we collect only what a single order requires.
Section 1: Information We Collect
1.1 Information You Provide at Checkout
To place and fulfill an order, the Platform requires you to provide:
- Your first and last name.
- Your mobile telephone number.
- Your email address.
- Your order details, including items selected, modifiers, pickup time, and any promotional code applied.
This information is necessary to prepare your order, identify you at pickup, and send your payment receipt. If you do not provide it, you will not be able to complete an order.
1.2 Payment Information
Payments are processed by iPOSPays, a Dejavoo Systems service, our third-party payment processor. When you pay by card, your card details are entered into a secure payment form hosted by our processor's tokenization provider and are transmitted directly to the processor under its own privacy policy and PCI-DSS security standards. If you pay using Apple Pay or Google Pay, your device supplies an encrypted payment token that is passed to the processor for decryption; we never see the underlying card details. Fresh Mart does not receive or store your full card number. We receive only confirmation of payment and a transaction reference number, which we store on your order so the transaction can be located if a refund or dispute arises.
Your email address and mobile telephone number are also passed to the processor so that it can issue your electronic payment receipt.
1.3 Push Notification Token
If you grant the App permission to send notifications, we collect a device push token issued by the Expo push service together with Apple Push Notification service or Google Firebase Cloud Messaging. We use this token solely to deliver order-status notifications (for example, letting you know your order is ready for pickup). You can disable this at any time in your device settings.
1.4 Crash and Error Diagnostics
To keep the App and our ordering systems working, we use Sentry, a third-party error-monitoring service. When the App or our servers encounter an error, Sentry receives a diagnostic report that may include the error message and technical stack trace, the App version and build, your device model and operating system version, the browser or client user agent, and your IP address.
These reports are configured to exclude personal information: request bodies and cookies are stripped before transmission, so your name, phone number, email address, order contents, and payment details are not sent to Sentry. We use these reports solely to diagnose and fix defects, not to profile you, and we do not enable performance tracing or session recording.
1.5 What We Do Not Collect
We do not build advertising or behavioral profiles about you. We do not use tracking cookies, cross-app tracking, IP-based geolocation tracking, or third-party ad networks. Apart from the crash and error diagnostics described in Section 1.4, we do not collect background telemetry about how you use the App.
Section 2: How We Use Your Information
We use the information above only to operate our ordering service:
- Name, phone number, and order details — to prepare your order, identify it at pickup, and contact you about that specific order if needed.
- Email address — to send you a receipt for your payment and any communication necessary to fulfill your order.
- Push notification token — to notify you when your order status changes, such as when it is ready for pickup.
- Crash and error diagnostics — to identify, reproduce, and fix defects in the App and our ordering systems.
We do not use your phone number or email to send marketing or promotional messages, and we do not send SMS/text-message marketing.
Section 3: How We Share Your Information
We do not sell, rent, lease, or trade your personal information, and we do not share it with advertising networks, data brokers, or marketing agencies. We share information only with the service providers that make ordering and payment possible, and only to the extent needed to provide the service:
- iPOSPays (Dejavoo Systems) — receives your payment details, together with your email address and mobile telephone number, to process your payment and issue your electronic receipt.
- Expo, Apple, and Google push services — receive your push token to deliver order-status notifications to your device.
- Sentry — receives the crash and error diagnostics described in Section 1.4, including your IP address.
We may also disclose information where required by law, legal process, or to protect our rights, property, or safety, or that of our customers.
Section 4: Data Retention
We retain your name, contact information, and order records for as long as needed to fulfill your order and to meet our legal, accounting, tax, and reporting obligations, and we delete them earlier on request as described in Section 5. Orders that are started but never paid for are discarded automatically within twenty-four hours. Payment records are retained by our payment processor under its own retention policies, and crash and error diagnostics are retained by Sentry on a rolling short-term basis.
Section 5: Your Choices and Rights
- Notifications. You can turn off push notifications at any time in your device's settings.
- Access and deletion. You may request access to, or deletion of, the personal information we hold about you by emailing legal@freshmartcorporate.com with the mobile telephone number used on your order so that we can locate your records. We will action such requests within 90 days. Because we do not offer accounts, this email address is the way to make a deletion request. We may need to retain a limited transaction record where accounting, tax, or other law requires it, and we will tell you if that applies.
Section 6: Security
We use administrative, physical, and technical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or loss. All data transmitted between the App and our systems, and onward to our payment processor and other service providers, is encrypted in transit using Transport Layer Security (TLS). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Section 7: Children's Privacy
The Platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.
Section 8: Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by updating the Effective Date above. Your continued use of the Platform after an update constitutes acceptance of the revised policy.
